The Manager according to Legislative Decree 81/08: Role, Tasks and Responsibilities
Legislative Decree No 81 of 9 April 2008, known as the Consolidated Text on Safety at Work, regulates the protection of health and safety in the workplace. Among the key figures identified by the legislator is theManager, a person who, by reason of his professional skills and the powers conferred on him, implements the employer’s directives and organises work while ensuring compliance with safety regulations.
Definition of the Manager
The Article2, paragraph 1, letter d)Legislative Decree No 81/08 defines a manager as ‘a person who, by reason of his professional skills and hierarchical and functional powers appropriate to the nature of the task entrusted to him, implements the employer’s directives by organising and supervising work’.
Tasks and Responsibilities of the Manager
The role of the manager involves specific functions and responsibilities established by theArticle 18of Legislative Decree 81/08. In particular, the Director must:
- Organising and managing workin compliance with safety rules;
- Implement the employer's directives, ensuring that prevention and protection measures are effective and properly applied;
- Supervising compliance with company provisionsand safety legislation;
- Training and informing workersthe risks associated with their duties and the security measures taken;
- Cooperate with the employer and the prevention and protection serviceto take the necessary measures to ensure safety;
- Report any critical issues or deficiencies in a timely mannersecurity measures and propose appropriate solutions.

Obligations and Sanctions
Failure to comply with the obligations laid down for the manager shall result in administrative and criminal penalties. The Article55 of Legislative Decree 81/08provides that the Director may be punished withimprisonment for up to six months or a fine of up to EUR 6 400in the event of non-implementation of the security measures provided for by law.
