Its training, constant updating and the correct application of prevention measures are essential to ensure a safe working environment in compliance with current legislation.

The Manager according to Legislative Decree 81/08: Role, Tasks and Responsibilities

Legislative Decree No 81 of 9 April 2008, known as the Consolidated Text on Safety at Work, regulates the protection of health and safety in the workplace. Among the key figures identified by the legislator is the Manager, a person who, by reason of his professional skills and the powers conferred on him, implements the employer’s directives and organises work while ensuring compliance with safety regulations.

Definition of the Manager

The Article 2, paragraph 1, letter d) Legislative Decree No 81/08 defines a manager as ‘a person who, by reason of his professional skills and hierarchical and functional powers appropriate to the nature of the task entrusted to him, implements the employer’s directives by organising and supervising work’.

Tasks and Responsibilities of the Manager

The role of the manager involves specific functions and responsibilities established by theArticle 18 of Legislative Decree 81/08. In particular, the Director must:

  • Organising and managing work in compliance with safety rules;
  • Implement the employer's directives, ensuring that prevention and protection measures are effective and properly applied;
  • Supervising compliance with company provisions and safety legislation;
  • Training and informing workers the risks associated with their duties and the security measures taken;
  • Cooperate with the employer and the prevention and protection service to take the necessary measures to ensure safety;
  • Report any critical issues or deficiencies in a timely manner security measures and propose appropriate solutions.

Obligations and Sanctions

Failure to comply with the obligations laid down for the manager shall result in administrative and criminal penalties. The Article 55 of Legislative Decree 81/08 provides that the Director may be punished with imprisonment for up to six months or a fine of up to EUR 6 400 in the event of non-implementation of the security measures provided for by law.
