On the website of the National Labour Inspectorate (INL) is available the revision of theLegislative Decree No 81 of 9 April 2008in June 2016 by DOTT. ING. GIANFRANCO AMATO, DOTT. ING. FERNANDO DI FIORE. Although the version does not play an official role, it is certainly the most comprehensive and best organized compendium on health and safety in the workplace.

In the current revision the novelties are:

• Amendments introduced to Articles 20, 28, 36, 37, 50, 222, 223, 227, 228, 229, 234(1), 235, 236(4) and Annexes XV, XXIV, XXV Section 3.2, XXVI Sections 1 and 5 and XLII by Legislative Decree No 39 of 15 February 2016 (OJ No 61 of 14 March 2016, in force since 29 March 2016);
• Questions Nos 6 to 10 of 2 November 2015, Nos 11 to 16 of 29 December 2015, Nos 1 to 4 of 21 March 2016 and Nos 5 to 10 of 12 May 2016 have been added.
• Replaced the Executive Decree of 29 September 2014 by the Executive Decree of 18 March 2016 concerning the twelfth list of persons authorised to carry out the periodic checks referred to in Article 71(11);
• Inserted the circular letter ref. 2597 of 10/02/2016 on the drafting of the POS for the mere supply of concrete;
• Corrected the amounts of the penalty for non-compliance with the suspension measure set out in Circular 33/2009;
• Corrected the penalties for infringements of Article 80(1) and deleted the notes to Article 80(3-bis);
• Corrected the picture of offenders referred to in Article 72;
• Inserted an extract from Circular No 26 of 12 October 2015 and letter ref. 19570 of 16 November 2015 on the amendments to the suspension of business activity referred to in Article 14;
• On the covers, updated the section of the Ministry’s website (www.lavoro.gov.it – Topics and priorities – Health and Safety) where it is possible to download the updated version of this document and correct the links to external documents, in view of the restructuring of the ministerial sites;
• Correct reference to point 2(c) of Annex II, point 3.2.3, to Ministerial Decree No 11/04/2011;
• Please insert notes concerning the repeal of Directive 89/686/EEC on personal protective equipment following the publication in the Official Journal of the European Union of 31 March 2016, L 81/51 of the new Regulation (EU) 2016/425.
