Legislative Decree No 81 of 9 April 2008

On the website of the National Labour Inspectorate (INL) is available the revision of the Legislative Decree No 81 of 9 April 2008 November 2020 by D.O.T. ING. GIANFRANCO AMATO, DOTT. ING. FERNANDO DI FIORE. Although the version does not play an official role as indicated by the authors, it is certainly the most comprehensive and best organized compendium on health and safety in the workplace.

In the current revision the novelties are:

• Enquiries No 1 of 23 January 2020 and No 2 of 20 February 2020 have been added;
• Inserted circular letter ref. 11056 of 31 March 2020 from the Ministry of Health on the extension to 31 July 2020 of the time limits laid down in Article 40(1);
• Inserted the circular letter of 29 April 2020 ref. 14915 of the Ministry of Health containing operational indications relating to the activities of the competent doctor in the context of measures to combat and contain the spread of the SARS-CoV-2 virus in the workplace and in the community.
• Amended Annex XXXVIII pursuant to the Interministerial Decree of 2 May 2020, published on the website of the Ministry of Labour and Social Policy on 13 May 2020;
• Article 242(6) and Annexes XLII and XLIII have been amended, pursuant to Legislative Decree No 44 of 1 June 2020 (published in Official Gazette No 145 of 9 June 2020, which entered into force on 24 June 2020);
• Article 180(3) has been amended pursuant to Legislative Decree No 101 of 31 July 2020 (published in Ordinary Supplement No 29 to Official Gazette No 201 of 12 August 2020, in force since 27 August 2020);
• Inserted the Decree of 7 August 2020 – Entitlement to operate steam generators;
• Added Circular No 13 of 4 September 2020 between the Ministry of Labour and Social Policy and the Ministry of Health concerning clarifications on the Circular of 29 April 2020 on fragile workers and Covid-19;
• Executive Decree No 57 of 18 September 2019 has been replaced by Executive Decree No 6 of 14 February 2020 – 23rd list of persons authorised to carry out the periodic checks referred to in Article 71(11) (LINK EXTERNAL to the Annex);
• Amended Annex XLVI pursuant to Decree-Law No 125 of 7 October 2020 (published in Official Gazette No 248 of 7 October 2020, in force since 8 October 2020).
• Inserted the circular letter of the INL of 23 October 2020 ref. 3395 concerning Decree No 94 of 7 August 2020 on authorisation to operate steam generators.
