On the website of the National Labour Inspectorate (INL) is available the revision of the Legislative Decree No 81 of 9 April 2008 in October 2013 by D.O.T. ING. GIANFRANCO AMATO, DOTT. ING. FERNANDO DI FIORE. Although the version does not play an official role, it is certainly the most comprehensive and best organized compendium on health and safety in the workplace.
In the current revision the novelties are:
- Inserted the amendments to Articles 8(4), 71(13-bis) and 73(5-bis), introduced by Article 11(5) of Decree-Law No 93 of 14 August 2013 laying down urgent provisions on security and combating gender-based violence, as well as on civil protection and provincial supervision, published in Official Gazette No 191 of 16 August 2013, which entered into force on 17 August 2013, converted, with amendments, into Law No 119 of 15 October 2013 (OJ No 242 of 15 October 2013);
- Inserted the amendments to Articles 3, 6, 26, 27, 29, 31, 32, 37, 67, 73, 71, 88, 104-bis, 225, 240, 250 and 277, introduced by Decree-Law No 69 of 21 June 2013 laying down urgent measures to relaunch the economy (Official Gazette No 144 of 21 June 2013 – Official Gazette No 50), converted with amendments by Law No 98 of 9 August 2013 (Official Gazette No 194 of 20 August 2013 – Official Gazette No 63).
- Updated the amounts of the penalties as provided for in Article 306(4-bis), as amended by Decree-Law No 76 of 28 June 2013 on ‘First urgent measures to promote employment, particularly among young people, social cohesion, as well as value added tax (VAT) and other urgent financial measures’ (Official Gazette No 150 of 28 June 2013), converted with amendments by Law No 99 of 9 August 2013 (Official Gazette No 196 of 22 August 2013).
- Inserted circulars 18, 21, 28, 30, 31 and 35 of the Ministry of Labour and Social Policies, as well as circulars of 10/05/2013 and 10/06/2013 of the Ministry of Health;
- Inserted the circular letters of 31/01/2013, 27/06/2013 and 02/07/2013;
- Added the Directorial Decree of the Ministry of Labour and Social Policies and the Ministry of Health of 30 May 2013 concerning the list of companies authorised to carry out live work on electrical installations powered by an industrial frequency with a voltage greater than 1000V pursuant to point 3.4 of Annex I to the Ministerial Decree of 4 February 2011.
- The Executive Decree of 24 April 2013 has been replaced by the Executive Decree of 31 July 2013 concerning the sixth list of persons authorised to carry out the periodic checks referred to in Article 71(11).
- Amended Article 4 of the Decree of the Ministry of Health of 9 July 2012 on: ‘Contents and methods of transmission of information relating to the aggregated health and risk data of workers ...’, pursuant to the Decree of the Ministry of Health and the Ministry of Labour of 6 August 2013 (Official Gazette No 212 of 10 September 2013);
- Amended Article 306(3) as provided for in Article 11 of Law No 96 of 4 June 2010 laying down ‘Provisions for the fulfilment of obligations arising from Italy’s membership of the European Communities – 2009 Community Law’, published in Official Gazette No 146 of 25 June 2010 – Official Gazette No 138, which entered into force on 10 July 2010; Note No 87 to Article 306(3) has also been added, given the repeal of Directive 2004/40/EC and the entry into force of the new 2013/35/EU, by postponing the deadline for the entry into force of the provisions of Chapter IV of Title VIII to 1 July 2016;
- A note has been inserted concerning the reorganisation of the collegiate bodies and other bodies operating at the Ministry of Health, including the Committee for the guidance and evaluation of active policies and for the national coordination of supervisory activities in the field of health and safety at work referred to in Article 5(1);
- Changed the links of documents external to this text as a result of changes in the addresses of the structure of the sites of the Ministry of Labour;
- Corrected the time reference ‘fifty-six’ in ‘fifty-five’ in Article 3(2).
