State-Regions Agreement of 25 July 2012

Agreement between the Government, the Regions and the Autonomous Provinces of Trento and Bolzano on the document proposed by the Ministry of Labour and Social Policy on ‘Adjustment and implementation of the agreements referred to in Article 34(2) and 37(2) of Legislative Decree No 81 of 9 April 2008, as amended’.

On July 25, 2012, at theState-Regions Conferencethe new agreement concerning theAdaptation and implementation of the agreements referred to in Article 34(2) and 37(2) of Legislative Decree No 81 of 9 April 2008.

The purpose of the agreement is to provide companies and supervisory bodies with clarifications on the training of employers wishing to carry out the tasks of the Prevention and Protection Service and of workers, managers and supervisors, adopted pursuant to Articles 34 and 37, respectively, of Legislative Decree No 81 of 9 April 2008, in accordance with the agreements of 21 December 2011.

This agreement, in Annex A, explains and clarifies some aspects of particular importance for the provision of courses and is divided into:
– Effectiveness of the agreements;
– Cooperation of joint bodies in training;
– Training in e-learning mode;
– Transitional rules and recognition of previous training;
– Updating of training;
– Training of the head of the prevention and protection service;
– Starting date of the update for ASPPs and RSPPs exempted under paragraph 5
Article 32 of Legislative Decree No 81/2008.

Of particular importance is also the part concerning theTraining in e-learning mode, where the legislature makes it clear, not by making any indication to the contrary, but by implicitly acknowledgingthe equivalence of distance learning in synchronous mode (Blended or Video Conference) with face-to-face training, clearly not applicable to training aspects requiring tests and/or practical exercises.

This point will certainly be the subject of much discussion, as it affects both the quality of training, aspects related to competition between training agencies, the validity of training courses provided through this mode.
